1. Acceptance of Terms

By accessing and placing an order through the ContainersPlusInc.com website (the “Site”), you, the customer (“You” or “Purchaser”), agree to be bound by these Terms and Conditions (“Terms”), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Product and Pricing Information

A. Product Condition and Description

We sell both new (“One-Trip”) and used shipping containers. All product descriptions, specifications, and condition grades (e.g., Cargo-Worthy, Wind and Water Tight) are accurate to the best of our ability. Photographs of used containers are intended to be representative. We will provide specific photos of the unit you are purchasing upon request to ensure transparency.

B. Pricing and Taxes

All prices are subject to change without notice. The final price includes the container unit cost and all applicable sales taxes, which will be calculated at checkout based on the delivery location.

C. Final Price and Fees

The total price displayed at checkout is the final price for the container unit and its oversized freight delivery. There are no hidden charges or merchant-imposed fees beyond those listed in the final checkout summary.

3. Order, Payment, and Cancellation

A. Order Confirmation

Orders are not considered accepted until Containers Plus Inc sends a final order confirmation email. This process is necessary to verify product availability and logistics.

B. Payment Method

We accept various payment methods, including major credit/debit cards and Bank Transfer (Wire Payment). For security and to secure high-value units, Bank Transfer details will be forwarded via email after order submission. Containers are not dispatched until full payment has been successfully received and verified.

C. Order Cancellation

If you wish to cancel an order, you must contact our Customer Service team M-F, 9 AM – 5 PM EST immediately.

• Before Shipment: Orders canceled before the container is dispatched from the depot may be subject to a cancellation fee to cover administrative and depot restocking costs.

• After Shipment: Orders cannot be canceled after the container has been picked up by the freight carrier.

4. Shipping, Delivery, and Risk

A. Shipping Method

All containers are delivered via oversized freight (LTL). Shipping costs and lead times are determined by the distance from our regional depots to your delivery address, as outlined in the Shipping Policy.

B. Curbside Delivery Responsibility

Delivery is strictly curbside. This means the container will be delivered to the location accessible by the freight truck at the public access point of your property.

• The Purchaser is solely responsible for ensuring the delivery site has adequate truck access.

• The Purchaser is responsible for offloading, placement, and maneuvering the container beyond the initial curbside drop-off.

C. Inspection and Acceptance of Risk

Risk of damage to the container passes to the Purchaser upon delivery.

• You, or your authorized representative, must inspect the container before the freight driver leaves the premises.

• Any significant damage or visible defects (beyond the grade condition purchased) must be noted on the Bill of Lading (BOL). Failure to note visible damage on the BOL constitutes acceptance of the container in its delivered condition.

5. Returns and Refunds

This section must be read in conjunction with our Return and Refund Policy.

A. Container Sales (New and Used)

Due to the high logistical cost of moving large oversized freight, all sales of new and used shipping containers are considered final sale, except in cases where the container is severely damaged upon initial delivery and the damage is noted on the BOL.

B. Accessories

Container accessories may be returned within 30 days of delivery, provided they are unused and in original condition.

C. Return Freight Charges

If a container return is approved under the specific terms of our Return Policy, the Purchaser is responsible for arranging and paying for the return freight charges back to the designated depot.

6. Limitation of Liability and Warranties

A. Warranties

We provide a 12-Month Watertight Guarantee on all used containers. Except for this guarantee, Containers Plus Inc makes no other warranties, expressed or implied, and hereby disclaims all other warranties, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

B. Limitation of Liability

Containers Plus Inc shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the products purchased, or for the cost of procurement of substitute goods and services, or resulting from any goods or services purchased or obtained, or messages received or transactions entered into through the site.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Alabama, United States.

You irrevocably agree that the courts located in Madison County, Alabama (which includes Huntsville, AL), shall have exclusive jurisdiction to resolve any dispute or claim arising out of or relating to these Terms or your use of the Site.
